Terms and conditions for Atelier Yearly Membership

Agreement between User and Atelier School of Art

For the purpose of this agreement the parties of Atelier School of Art both in person and online will herein be referred to as Atelier in this document. Participants, whether ongoing students, visiting students, workshop attendees, online students, and in person students will herein be referred to as User.

This Agreement Includes Both Online and In-Person Activities

Welcome to www.AtelierSchoolofArt.com. The www.AtelierSchoolofArt.com website (the "Site") is comprised of various web pages operated by Atelier School of Art ("Atelier"). www.AtelierSchoolofArt.com is offered to the User conditioned on the User’s acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). The User’s use of Atelier School of Art services constitutes their agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Website

The User’s use of the Atelier website is subject to Atelier’s terms and conditions. Please review our terms and conditions below which also governs the website and informs users of our data collection practices.

Electronic Communications

Visiting www.AtelierSchoolofArt.com or sending emails to Atelier School of Art constitutes electronic communications. The User consents to receive electronic communications and agrees that all agreements, notices, disclosures and other communications that Atelier provides to the User electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

User’s Account

The User is responsible for maintaining the confidentiality of thier account and password and for restricting access to their computer, and agrees to accept responsibility for all activities that occur under the User’s account or password. The User may not assign or otherwise transfer their account to any other person or entity. The User acknowledges that Atelier is not responsible for third party access to the User’s account that results from theft or misappropriation of their account. Atelier and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Children Under 18

Atelier does not knowingly collect, either online or offline, personal information from persons under the age of eighteen. If the User is under 18 years old, they may only use www.AtelierSchoolofArt.com and it’s account services only with permission of a parent or guardian.

COVID 19 Policy

Proof of Vaccination for COVID-19 is required to attend in-person classes at Atelier for students ages 18 and up. User must bring their vaccination card to their first class or email it to info@atelierart.studio.

Masks are optional for all instructors, staff and students while working indoors.

Atelier School of Art is not liable if a member, guest or visitor contracts any illness including COVID-19 while on our premises. All classes and workshops are taken at the student’s own risk.

Class Changes

Atelier reserves the right to withdraw or change classes, instructors, or schedules; to revise tuition & fee structures; and to amend its policies as necessary for the smooth and efficient operation of the institution.

Gift Certificates

Atelier gift certificates may be purchased from Atelier and are effective for one year from the date of purchase. Gift Certificates may be used for class tuition, membership and/or workshops.

Membership

Members: Students can become a member at any time. Members pay an annual fee of $200 to receive a 15% discount on all classes and workshops during those 12 months. Discounted rates begin on the first day of the student’s membership. Annual memberships are non-refundable.

Membership benefits include the ability to reschedule classes.

Cancellation/Make-Ups

  • Members have the option to reschedule classes or schedule make-up sessions if cancellation occurs within 48 hours prior to their scheduled class time. Rescheduling or make-up sessions are not available if cancellation takes place within 48 hours of class time.

  • Rescheduled classes are required to take place within 30 days of the missed session. If you need to reschedule a class, please use the rescheduling form in the member lounge or call the studio phone at 248-951-4400.

  • The make-ups can be used within an existing class or in another class of the student’s choosing.

  • 2 weeks notice must be given in order to cancel the payment plan prior to the next billing cycle.

  • Workshops are fully refundable with at least 7 days notice, and are partially refundable for 50% of the workshop cost if canceled up to 48 hours before the scheduled start of a workshop. Cancellations are not permitted with less than 48 hours notice and no refund will be issued.

Tuition

Billing takes place on the first of each month and covers classes for that month. No refunds will be given if a student cannot attend classes for any reason. The billing payments occur automatically until the student decides to cancel participation. See cancellation/make-up section for further details.

  • Member Price: $204/month

  • Non-Member Price: $240

  • Some classes, camps & workshops may also have a materials &/or model fee attached depending on the course of study.

  • Workshops require 7 days notice of cancellation for a full refund.

Promotional Photography

Atelier reserves the right to photograph activities, artwork &/or social events held on the Atelier campus & at offsite locations. Atelier students, members, guests, & works of art from the studios or exhibition areas can all be subjects of interest. Images may be used for Atelier’s educational & promotional purposes unless otherwise notified in advance by any student, patron or visitor.

Arrival/Departure

Please arrive no more than 10 minutes before your scheduled class time to allow the instructor time to set up and prepare.

Classrooms should be vacated within 5-10 minutes of class ending to allow staff and instructors time to set-up/clean for the next class.

Phone Calls/Classroom Etiquette

Phone calls should not take place during class times or within the shared studio spaces. If a student has to answer a phone call, we ask that they remove themselves from the shared studio space, being considerate to not disrupt or distract the other students or instruction.

Inclement Weather or Emergency Closings

Due to inclement weather or an emergency, Atelier will announce the cancellation of classes via email. Atelier follows Royal Oak School District’s snow day policy. Class sessions canceled for inclement weather or emergencies by Atelier will be rescheduled or held online via zoom.

International Users

The Service is controlled, operated and administered by Atelier from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Atelier Content accessed through

in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ATELIER SCHOOL OF ART AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

ATELIER SCHOOL OF ART AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. ATELIER SCHOOL OF ART AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATELIER SCHOOL OF ART AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ATELIER SCHOOL OF ART OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Atelier reserves the right, in its sole discretion, to terminate your access to the Atelier site and/or in person studio the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Michigan and you hereby consent to the exclusive jurisdiction and venue of courts in Michigan in all disputes arising out of or relating to the use of the Atelier site, or in person services. Use of the Atelier site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

Changes to Terms

Atelier reserves the right, in its sole discretion, to change the Terms under which

is offered. The most current version of the Terms will supersede all previous versions. Atelier encourages you to periodically review the Terms to stay informed of our updates.

Liability

By signing these terms and conditions I hereby agree to be responsible and accountable for the conduct and actions of myself, my child/children while in the care of Atelier School of Art, it’s instructors and/or staff members.

Furthermore, I agree to release Atelier School of Art, all instructors and staff and will hold them harmless from any liability which may arise from incidents or accidents involving myself, my child/children while on Atelier’s premises, to the extent allowed by law.

My signature below signifies that my participation in this program or courses and at this facility is at my own risk and the risk of my child/children.
